(a) you must produce to Victory the original Tax Invoice or other proof of purchase document disclosing the purchase date;

(b) you must pay the costs of all cartage, freight, transport and travelling expenses involved in delivering the Equipment to Victory or its nominated service agent or contractor or deliver the Equipment to Victory or its nominated service agent or contractor and the costs of re-delivery to you; and

(c) you must provide sufficient proof (e.g. details, service records, copies of Tax Invoices) of the service undertaken at 100 hours of use, 250 hours of use, 500 hours of use, 750 hours of use and 1,000 hours of use (as applicable).

Once you get the document ready, please scan and email to victory.warranty@hotmail.com, victory Equipment would lodge your claim within 10 business days.

WARRANTY

1. Victory Equipment Australia Pty Ltd (“Victory”) warrants to you, the customer, that, under proper use in accordance with Victory’s specifications and instructions (if any) and subject to the Specified Exclusions specified below the Equipment purchased by you from Victory will be free from defects solely due to faulty workmanship and materials:-

(a) for General parts: eg. Main Pumps, Main Valves, Pilot control pumps, Engines, Transmissions, Cylinders (not including seal kits), for the period of the earlier of:-

(i) 12 months of the date of dispatch from Victory’s premises; or

(ii) 1200 hours of use of the Equipment;

(b) for Rubber parts: for the period of the earlier of:-

(i) 3 months from the date of dispatch from Victory’s premises;

(ii) 500 hours of use of the Equipment

2. Victory gives no warranty to you in respect to consumable parts eg. Filters, Globes for lights, Brake Pads, bucket, teeth, fasteners, fan belt.

SPECIFIED EXCLUSIONS

3. This Warranty does not cover defects or damage caused by:-

(a) improper use, abusive use or mismanagement of the Equipment by you;

(b) operation of the Equipment other than in accordance with the specifications and instructions given by Victory;

(c) use of the Equipment in a manner not reasonably contemplated by Victory;

(d) use of the Equipment in a manner contrary to law;

(e) subjection of the Equipment to unusual or unrecommended physical, environmental or electrical stress;

(f) your failure or refusal to install engineering changes or enhancements recommended by Victory;

(g) operation of the Equipment with incorrect fuel to oil ratio;

(h) fair wear and tear on the Equipment or neglect of the Equipment;

(i) abnormal performance caused by ancillary equipment interference or other external factors;

(j) use of non-authorised or non-standard parts;

(k) repairs, modifications or other work carried out on the Equipment other than by Victory or by Victory’s authorised service agent or contractor;

(l) use of the Equipment by a person other than you and this warranty does not cover Equipment purchased:-

(i) other than from Victory (such as purchases from unauthorised dealers and purchases over the internet, from local/international sellers or sites such as eBay and Amazon;

(ii) at an auction; or

(iii) from a private seller;

(m) your failure to maintain the Equipment the Equipment by undertaking a service at 100 hours of use, 250 hours of use, 500 hours of use, 750 hours of use and 1,000 hours of use, at your sole cost and expense or your failure to keep the Equipment fully lubricated.

WARRANTY CLAIMS

4. If you consider that any Equipment supplied by Victory is defective, you can lodge a claim under this Warranty, to the extent necessary to correct an apparent defect, Victory will inspect and repair or replace the Equipment at no additional charge to you subject to the following conditions:-

(a) you must produce to Victory the original Tax Invoice or other proof of purchase document disclosing the purchase date;

(b) you must pay the costs of all cartage, freight, transport and travelling expenses involved in delivering the Equipment to Victory or its nominated service agent or contractor or deliver the Equipment to Victory or its nominated service agent or contractor and the costs of re-delivery to you; and

(c) you must provide sufficient proof (e.g. details, service records, copies of Tax Invoices) of the service undertaken at 100 hours of use, 250 hours of use, 500 hours of use, 750 hours of use and 1,000 hours of use (as applicable).

5. If Victory elects to replace the Equipment entirely (rather than repair it) then Victory may replace the Equipment with Equipment that is substantially the same as the Equipment sold to you, including Equipment that has been used for a similar number of hours of use and/or contains aftermarket or refurbished parts.

1. DEFINITIONS In these terms and conditions the following terms shall have the following meaning:-
“CLAIMS” means any actions, claims, expenses, demands, costs, damages, proceedings or any other liability whatsoever, including legal costs on an indemnity basis;
“EQUIPMENT” means the goods more particularly described in the Tax Invoice which are to be supplied by Victory to You pursuant to these Terms;
“ORDER” means an offer to purchase the Equipment from Victory, whether oral or in writing, including by way of electronic communication;
“TAX INVOICE” means the tax invoice issued by Victory;
“TERMS” means these Terms and Conditions of Sale;
“VICTORY” means Victory Equipment Australia Pty Ltd ABN 61 149 525 299;
“YOU” means, and “YOUR” is a reference to, the corporation, person or entity described in the Tax Invoice, being the customer; and
WORDS in the singular shall include the plural and vice versa, if the context permits.
2. ACCEPTANCE (a) Your Order is accepted by Victory on the basis that these Terms constitute the entire legally binding contract between Victory and You.
(b) These Terms supersede all prior discussions, representations, agreements and arrangements in relation to the purchase of the Equipment.
(c) These Terms apply despite any terms and conditions contained in Your purchase Order and any terms and conditions deviating from or inconsistent with these Terms have no legal effect, do not constitute part of the Terms and will not bind Victory notwithstanding any statement made by You in your Order that your terms and conditions will prevail over these Terms.
3. SPECIFICATIONS You acknowledge that:-
(a) You have not relied on any service involving skill or judgment, or any advice, recommendation, information or assistance provided by Victory in relation to the Equipment or its use or application;
(ii) You have the sole responsibility of satisfying yourself that the Equipment is suitable for your use or your contemplated use, whether or not such use is known by Victory;
(iii) any description of the Equipment provided in the Tax Invoice or other document supplied by Victory is given by way of identification only and the use of such description does not constitute a contract of sale by description; and
(iv) variation by Victory within the specification for the Equipment does not constitute a breach of contract or impose any liability on Victory whatsoever.
4. PRICE & PAYMENT (a) Victory is entitled to and will issue a Tax Invoice to You for the price of the Equipment prior to delivery of the Equipment to You or collection of the Equipment by You.
(b) The price for the Equipment is the price specified in the Tax Invoice and GST is payable by You as specified in the Tax invoice. The price includes delivery costs unless otherwise stated on the Tax Invoice.
(c) The price plus GST must be paid by You in full in clear funds prior to or on delivery of the Equipment or collection of the Equipment by You.
(d) If You fail to take delivery or collect the Equipment or fail to give Victory adequate delivery instructions at the time stated for delivery then, without limiting any other right or remedy available to Victory, Victory may:-
(i) store the Equipment until actual delivery or collection and charge You for the reasonable costs (including insurance) of storage; or
(ii) sell the Equipment at the best price readily obtainable and (after deducting all reasonable storage and selling expenses) account to You for the excess over the price under these Terms or charge You for any shortfall below the price payable under these Terms.
5. DELIVERY, COLLECTION & AVAILABILITY (a) Delivery of the Equipment will be made by Victory delivering the Equipment to your premises, or if some other place for delivery is agreed by Victory and You, by Victory delivering the Equipment to that place, or where agreed, by You collecting the Equipment at Victory’s premises.
(b) If delivery has been agreed, Victory will arrange delivery as near to the destination as safe hard road permits. You are responsible for providing free of charge labour and lifting gear for unloading. You are responsible for ensuring that the Equipment is unloaded with reasonable dispatch. If the delivery vehicle is detained for an unreasonable period Victory reserves the right to make an extra charge to You for such delay.
(c) Any dates quoted for the availability of the Equipment are approximate only and Victory shall not be liable for any Claims arising from delay in the availability of the Equipment however caused. Time for delivery or collection shall not be of the essence of these Terms.
(d) Where the Equipment is to be supplied in instalments or in more than one supply, each supply shall constitute a separate contract and failure by Victory to supply or make available any one of the instalments or supplies in accordance with these Terms or any Claim by You in respect of any one or more instalments shall not entitle You to treat these Terms as repudiated.
6. DAMAGE OR LOSS IN TRANSIT (a) Where carriage is the responsibility of Victory, Victory will repair or replace free of charge, the choice being at Victory’s absolute discretion, any Equipment lost or damaged in transit to the contractual point of delivery provided written notice of loss or damage is given to Victory within 3 days of delivery or expected delivery to enable Victory to comply with the carrier’s conditions of carriage applicable to such loss or damage in transit.
(b) Victory is not responsible for any loss or damage to the Equipment caused by or arising from transport or delivery of the Equipment if Victory has not loaded the Equipment or You have nominated the carrier.
(c) Claims made for loss or damage in transit must be made against the carrier in the manner notified by Victory to You.
7. FORCE MAJEURE (a) Victory shall not be liable to You or be deemed to be in breach of these Terms by reason of any delay in performing, or any failure to perform, any of Victory’s obligations in relation to the Equipment, if the delay is due to any cause beyond Victory’s reasonable control. Without limiting the generality of the foregoing, the following shall be regarded as causes beyond Victory’s reasonable control:-
(i) acts of God, explosion, flood, tempest or accident;
(ii) war or threat of war, sabotage, terrorism, insurrection, civil disturbance or requisition;
(iii) acts, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;
(iv) import or export regulations or embargoes;
(v) strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of Victory or of a third party);
(vi) difficulties in obtaining materials, labour, fuel, parts or machinery;
(vii) power failure or breakdown in machinery.
(b) If, through circumstances beyond the control of Victory, Victory is unable to effect delivery or supply of the Equipment, then Victory may cancel Your Order (even if has already been accepted) by notice in writing to You.
(c) No purported cancellation or suspension of an Order or any part of it by You is binding on Victory after the Order has been accepted.
8. EXPRESS WARRANTY (a) Victory gives You a warranty in the form and subject always to the terms and conditions set out in the Warranty Book supplied by Victory with the Equipment.
(b) The warranty contained in the Warranty Book is provided exclusively to You and the warranty may not be assigned or otherwise transferred by You to any third party without the prior written consent of Victory, which may be given or withheld in Victory’s absolute discretion, and if given, may be given subject to conditions.
9. IMPLIED WARRRANTIES & LIMITATIONS (a) Any conditions or warranties that may be implied into these Terms by the Competition and Consumer Act 2010 (Cth) and/or the Goods Act 1958 (Vic) or any other, Commonwealth, State or Territory legislation for Your benefit that may lawfully be excluded are agreed to be excluded to the full extent permitted by law. Further, to the extent permitted by law, if Victory becomes liable to You in any manner whatsoever for breach of any implied condition or warranty then Victory’s liability shall be limited to any one or more of the following, selected by Victory at its sole option:-
(i) the replacement of the Equipment or the supply of equivalent goods;
(ii) the repair of the Equipment;
(iii) the payment of the cost of replacing the Equipment or of acquiring equivalent Equipment; or
(iv) the payment of the cost of having the Equipment repaired.
(b) Further, Victory is not liable to You under any circumstances for;-
(i) any special, indirect, economic or consequential loss or damage which You may sustain howsoever arising; or
(ii) to the extent permitted by law, damage to person or property howsoever arising, whether in tort or in contract or any other basis and to the extent permitted by law, You indemnify Victory, against any Claims suffered by Victory in connection with You using the Equipment including without limitation, You using or incorporating the Equipment in other goods used by You or supplied to You.
10. VARIATIONS & WAIVER You agree: (a) that no variation to these Terms shall be binding on Victory unless assented to by Victory in a document prepared by Victory and signed by one of its directors; and
(b) any failure by Victory to insist upon strict performance of any term, condition, warranty or clause shall not be deemed to be a waiver of the same, and any express waiver of any term, condition, warranty or clause shall not be deemed to be a subsequent waiver of the same.
11. JOINT & SEVERAL/ ESTATE Where You comprise two or more persons, corporations or entities, these Terms will be binding upon You jointly and severally. In addition these Terms will be binding upon any of your legal personal representatives or permitted transferees.
12. ASSIGNMENT You cannot not assign or otherwise transmit these Terms without the prior written consent of Victory, which consent may be given or withheld in Victory’s absolute discretion.
13. NOTICES Any notice, consent or demand given under these Terms must be given in writing. The service of any notice, document or court proceedings on You shall be deemed to have occurred if posted by ordinary mail to Your address specified in the Tax Invoice.
14. GOVERNING LAW These Terms shall at all times be governed by the laws of the State of Victoria and Victory and You hereby irrevocably submit to the exclusive jurisdiction of the courts of the State of Victoria and the Courts of Appeal therefrom.
